• No Resale or Unlawful Framing: You may not mirror, republish, or embed the test engine in an unauthorized manner without written consent.
• Fair Use: The tool is provided free of charge on a fair-use basis. Excessive continuous querying may trigger automated temporary rate limits.

3. Nature of Speed Test Results & Disclaimer of Warranties

Internet speed test measurements depend on numerous external factors beyond our control, including but not limited to:

• Wi-Fi signal attenuation, router processing overhead, and RF channel congestion.
• Concurrent household bandwidth consumption (streaming, downloads, smart home devices).
• Local device processor throttling, background operating system tasks, and browser tab memory limits.
• Internet Service Provider (ISP) transit peering, dynamic throttling, and geographic routing decisions.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, NETSPEEDTESTS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL NETSPEEDTESTS, ITS FOUNDERS, EMPLOYEES, AFFILIATES, OR INFRASTRUCTURE PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

• Your use or inability to use the speed testing service;
• Any ISP dispute, breach of contract claim, or billing adjustment initiated using test outputs;
• Data usage consumption incurred while running bandwidth tests (e.g., cellular data cap usage);
• Any errors, omissions, interruptions, delays, or temporary unavailability of testing nodes.

BECAUSE CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Indemnification

You agree to defend, indemnify, and hold harmless NetSpeedTests and its affiliates against any claims, liabilities, damages, losses, and reasonable legal expenses arising from or in any way connected with your violation of these Terms or misuse of the Website.
